NSA mines our data regardless of whether we're in America or not.
It's for national security you see. If a European says something like "America is a joke of a country", that could secretly be a veiled threat and they may be planning a coup. They need this info so they can determine whether such people need to be abducted and taken to Guantanamo Bay for further questioning.
I don't know how extensive the American surveillance network actually is, but if your traffic is routed through an American server at any point along its route, then they probably have that data, even if you aren't American.
I don't know how encryption factors into this, but I know that in the past, the NSA relied on unknown security exploits to get access to data that should have otherwise been inaccessible. They had to stop that once the hackers discovered those exploits and they got patched, though I'm sure that they still have a few tricks up their sleeves.
TLDR: The NSA is a slimey organization and Edward Snowden has already proven that they have access to your nudes.
