The current justice system actually has a lot of history behind it - back in the old 2D versions, justice was mandatory and started up as soon as the Manager arrived (at around population 20), and it got upgraded to include the Fortress Guard with the Mayor (population 50) and added the Hammerer once the Baron arrived (when you had the Manager, Broker, and Bookkeeper).

The fact that you can omit it entirely in the current version is something of a side effect of the way the rest of the game has been changing - back in 40d you could skip appointing a Sheriff but the Hammerer's arrival was guaranteed, and from 0.31 onward all nobles effectively became optional.
