My other problems with McCain aside, he's been good when it's come to the Tea-Party. Arizona will be better off for it, especially given it might ease up their hard-line on immigration.

So, I just heard on the radio about the Boston Marathon bombing guy... Jury selection, people against the death penalty are disqualified.  Is that a thing that normally happens?

It isn't unheard of for the prosecution to strike jurors who are against the death penalty, but the defense doesn't usually do so for obvious reasons. If they're both striking them then something fishy might be going on, but it's more likely IMO that the practice is only just being noticed because of its relevance in a nationally interesting case and isn't unusual otherwise.

Yep.

A juror must be willing to consider all sentencing options as a consequence of their verdict. To be death qualified you must be willing to return a guilty verdict where the death penalty may be the result.

It's basically to avoid jury nullification of the death penalty, somewhat wrongly in my eyes, but there you go.

Smiling thug attacks female MTA employee in the Bronx: cops

The victim, who was on duty and in full uniform, was standing on the southbound platform of the East Tremont train station at 2:30 a.m. on Dec. 23 when the unidentified suspect ran up and attacked her.

After throttling the woman, the man hightailed it out of the station, police said. Surveillance cameras caught the man, wearing a black jacket, brown pants and black sneakers grinning as he made his way through the turnstile.

The MTA employee was rushed to a local hospital with minor injuries to her head, neck and back, officials said. Her position with the Transit Authority was not immediately disclosed.

Once Lolja saw the video on the news, he turned himself in at the 25th Precinct in Harlem, where he’s been a cop for seven years, police sources said.

The officer said he fought with the conductor after she cursed at him for asking when the next train would arrive. When he demanded her ID and took out his phone to take a picture of her, she grabbed it, prompting a struggle, he alleged.

No charges were immediately filed. The NYPD’s Internal Affairs Bureau is investigating the incident.

No longer a grinning deranged thug. No longer a large man dangerous to society for his questionable slavic ethnicity. No longer is it a clear cut case of a man assaulting a person for no reason. No, he has a reason, she tried to take his phone according to his hearsay, so he choked her and slammed her into the ground causing hospitalization. Also the charges still aren't being brought up despite days after turning himself in once it was impossible for him to walk the streets without being noticed as the smiling thug. How cute.


I find it hilarious how blatant this shit is anymore.

The cops ARE the criminals. They are a highly organized gang controlling the streets with an iron fist.

They are the guard dogs of the rich and powerful, who can no longer keep them on a leash.

I believe we need cops, but it appears we do not need them as much as one might think.

It isn't just the death penalty in particular. The idea is that changes to the structure of the law should always be a matter for the ballot box, or occasionally for the expert legal reasoning of a seasoned judge rather than by one or two citizens using the duty of jury service as a soapbox. This is why any strong opinion on a facet of a case is grounds for summary dismissal by either the prosecutor or the defense.

Of course, nobody can actually prove that you aren't qualified unless you admit it. It's illegal not to admit it, but there is virtually no way you'd get caught unless you are open about it with the other jurors and they are both aware of the concept and willing to rat you out about it.

On the other hand, if you don't want to serve on a jury at all, it might be a good idea to imply/hint/explicitly state that you are aware of the concept of jury nullification and support it. They will thank you for your time at the speed of light.

Death Penalty should never have returned. One criminal made the Supreme Court change their mind. Were they oblivious to the fact that yes, people will do unspeakable things. That changes nothing. The state has no right to murder others any more than anyone else.

Just one more deeply disturbing and depressing thing about America.
