Pretty crazy the most common crime your dwarfs will commit (being unable to accomplish some stupid noble request because the noble has preferences for stuff you don't have access to like glass on a sandless map) is normally punishable by death, and it's been this way the entire time and we haven't really paid attention because we never appoint hammerers. I think it should be downgraded to imprisonment by default, and only hammering for murder/espionage.

Well, that's nobles for you. They were much worse in the real world.

If you want the punishment to be downgraded for mandate violations, you can edit the ethics of dwarves in the entity file. (Personally, I'm against changing it to a milder punishment in the regular game. Nobles should be jerks and hated.)

Is murder a hammering or just imprisonment? I'll be very annoyed if not making shell crafts after fish go extinct is death while a vampire who's killed 8 dwarfs only gets time served and goes right back to draining dorfs as soon as he's out.

Hammering, although vampires tend to survive that.

Hammering, although vampires tend to survive that.

Pretty sure if the hammering knocks their teeth out they don't bite anymore.

Assuming that beatings are supposed to be corporal punishment (and not maimings), they are much much more severe than they really should be.  At most, corporal punishment should cause transient pain and transient marks such as welts and redness (and at most light bruising for the most severe punishments), all of which should not required any medical care to recuperate from (though, depending on the severity of the punishment, the affected dwarf may need to rest for up to a few days before they can do anything).  Corporal punishment should never result in the dwarf being punished being placed at risk of life, nor risk of losing the functions of one or more limbs, senses, faculties, or ability to procreate, nor anything else that should require medical attention.

The other (possible) problem is with how dwarves react to being punished.  It would be nice if being punished would lead to lead to the punished dwarf being less likely to commit further crimes in the future (it’d also be nice if witnessing another dwarf being punished would have a similar effect).

As for hammering, dwarves should never be given a set number of hammer strikes.  Instead, the sentence should be for the dwarf to be “hammered until dead” and the hammerer (after chaining the condemned dwarf and removing any headgear) should simply apply as many hammer strikes as it takes until the condemned dwarf is, in fact, dead.

Interesting. This could also go the other way around, and also affect the punisher and the punished kin/loved one..

We aren't necessarily going for realism here, otherwise given how common corporal punishment were for anything imaginable like being late for work details, Dwarf fortress might turn into BDSM dungeon..

On serious note, maybe alongside the villain update they could introduce a law system to give us more leeway in how to handle various offences. Maybe introduce the ability of quirky nobles to grant clemency, choose whether the execution will be a public event, and maybe more creative punishments how about shaving off a dwarves beard?

A law system would be huge, not only how offences are handled, but also what counts as offence.
Dwarves may petition for certain laws. The mountain home may try to force you to adopt some new cruel laws they introduced. Scholars /Books on Ethics and laws may have a huge impact on the fort and daily life. Agents from other civs, religious cults, all trying influence it.
