Well, she is going to end up in jail in the end, waiting for the Emperor to show up and begin Oblivion proper, so it's kind of a foregone conclusion.
Did TES always start with you in jail, or is that just a oblivion thing?

They've all started as a prisoner of some kind. Morrowind had you being released by the Emperor's order, Oblivion had the hilarious scene where you ask the Emperor why you're in prison and he's like "damned if I know", and Skyrim had you being executed for wearing rags and being in the general vicinity of Stormcloaks.

Arena starts you in prison, Morrowind starts you on a prison boat where you're being let free due to the Emperor's pardon, Oblivion starts you in the exact same prison Arena starts you in IIRC, Skyrim you start as a prisoner about to be executed.

Daggerfall you start as a trusted aide of the Emperor being sent to deal with a horrid political situation in Daggerfall in High Rock... but most of the character backstories involve you having been at some point either a prisoner or at least an outlaw.

Being a prisoner is a pretty good start to any RPG, because the usual behavior of a player is pretty similar to a violent criminal who needs to be locked up.

Unless it's one of the bits where she's an alcoholic and drinks regardless of the voices in her head, you'd be surprised how stupid people suggesting things are. It's like people have never read a story before.

Unless you roleplay as a really GOOD character, in which case it's an indictment of the RPG criminal justice system.

Granted, in a land where the guards literally run at you with their swords out for stealing a roll, that's pretty much granted as a shitty system anyway.

Interesting question: RPGs with law systems that weren't just "Steal a roll? EXECUTION WITHOUT TRIAL"?

To be fair, they do offer to arrest or fine you :P

Only RPG I can think of with an interesting justice system would be Liberal Crime Squad.  Actually has trials, and the laws matter.  It's no Phoenix Wright but it's pretty good!

I do wish there was a survival horror game like Alien Isolation, where you play as a minion of an evil empire trying to survive against a series of highly intelligent heroes based off stereotypical RPG/FPS protagonists.

Fantasy kingdoms are actually all really genre-savvy, so they like to maintain stables of imprisoned adventurers. Any time a crisis threatens they just point them all in the direction of the enemy and unclip their leashes.
