Extremely Severe Consequences

So I had recruited a member to act as a leader for a second squad, and I was trying to get his juice up so he could recruit more people. I send the guy to spray paint, and all of a sudden, a Death Squad Officer comes out of nowhere and kills him on the spot. The worst thing is, this is the first time this has happened, every time I attempt to spray paint, this happens.

Death Squads respond to any and all crimes, including spray painting, with lethal force.

Spray painters will always eventually get spotted. Street sense skill helps, but won't make it impossible to get spotted.

And when you get spotted, you have three options...

1. RUUUUUN! (works pretty bad for Death Squads unless your character is very agile - Death Squads are fast too)
2. Fight (works pretty bad against any group of multiple armed enemies, except if your character is nearly superhuman)
3. Give up (doesn't work at all on death squads, but if you're being arrested by normal police and don't want to risk death, you're likely to get away with the charges dropped or a short sentence... unless death penalty laws are Arch Conservative)

Death squads make graffiti a bad strategy, so it works much less well in nightmare mode.

Murals are (or used to be?) very powerful apart from the chance of getting interrupted. For agile characters, this isn't such a problem once death squads are abolished. However, murals do have a great element of overpowering - the only criminal charge you get is vandalism if you get seen. For comparison, you can rack up dozens of vandalism charges at various sites with much less political impact.

Vandalism can get you death sentences. My uber man, The One Eyed Nyan Scout, had racked up multiple charges of murder, assualt, armed assualt, and got away scotch clean. Awesome self lawyer. I get a few vandalism charges from graffiti. 27 years in prison. 26 years have passed, and the death penalty goes back to C+. I was hanged. Those pretty pictures can get you in trouble man.

Murals are basically what people doing graffiti in the 'A'ctivate screen do. The other type of graffiti is tags that can be sprayed on sites.

Sounds like a bug to me. In any case, the biggest problem with vandalism is that you get one charge for each site tag (and a single site tag is almost ridiculously weak) but murals, a much more powerful activity, only yield a single count and only in the case you get seen.

hmm some one should fix what happened to scout because theres a parts say its illegal it'll make the game more real and balanced

It is illegal. Shouldn't it be? The biggest flaw is the fact that it's not illegal enough versus power (and again, other crimes of vandalism). As for "commuting" to death sentence, I think they shouldn't do that. They'll start educating your character though, eventually resulting in Conservatism laying eggs in his/her/its brain.

What is punishable by death depends on the political situation. When you play Nightmare Mode, the political situation starts in a dystopian hell in which death squads execute you for loitering in the wrong place. You can change this by turning the public against the death penalty or the police. Either issue becoming more Liberal will abolish the death squads. Fixing the death penalty issue will ensure you're never sentenced to death for minor crimes either.

Until that happens, the world is a very scary place. It's your job to fix it.

If you play without having Nightmare Mode on, and the laws won't start so extreme. If enough time passes, they'll still regress to that point though.

Fixing the police regulation issue to anything else than C+ will always give you a chance to surrender to cops. You may still get executed after trial if the death penalty laws are C+ and you fail to conjure up a proper defence.
