I am not comparing it to digital piracy in basis, but rather ease of evasion. Unless someone walks around casting spells without concealing it somehow, they can't prove it. Just like how the bomber cast their spells using the air around a specific person to misdirect, or Cyrielle fired her rifle without being even near it, a magic user could just stick to a crowd, cast their spell and as long as fireball doesn't fire out directly from their location, there's deniability.

Because he's a famous magic user who would inevitably be given a deal he doesn't want by some government and if he tried speaking out against this idea he would probably be made out as a villain and have a fall from grace and really it's just simpler over all to fake his death or go into hiding.
